Introduction

These Terms of Service, together with any policies referenced below, govern your access to and use of amu.pet and the Amu Country Series featured shopping experience, our online store, products, content, communications, and any other services that link to these Terms (collectively, the "Services").

These Terms are a legal agreement between you and Amu Pets LLC ("AMU," "we," "us," or "our"). By accessing or using the Services, creating an account, signing up for communications, placing an order, or otherwise interacting with AMU, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services or make a purchase from AMU. By using the Services, you represent that you have the legal capacity to enter into these Terms. If you use the Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Our Products

AMU sells dog accessories and related lifestyle products, including collars, harnesses, leashes, wristbands, and other products that may be offered from time to time. Product descriptions, images, colors, sizing, availability, pricing, materials, and other details are provided for convenience and may change at any time. We make reasonable efforts to display products accurately, but we do not guarantee that product colors, textures, materials, dimensions, or details will appear exactly as shown on your device or screen. Minor variations may occur due to materials, production, manufacturing, photography, lighting, device settings, or other factors.

3. Product Safety and Pet Use

You are responsible for determining whether any AMU product is appropriate for your dog or pet, including based on size, breed, strength, temperament, behavior, health, activity level, and environment. AMU products are not a substitute for responsible pet ownership, proper supervision, professional training, veterinary advice, or appropriate safety precautions.

You agree that you are solely responsible for:

  • Selecting the appropriate product and size for your dog;
  • Properly fitting, using, maintaining, and supervising use of any AMU product;
  • Inspecting collars, harnesses, leashes, clasps, buckles, D-rings, stitching, wristbands, and other materials before each use;
  • Discontinuing use if a product appears worn, damaged, chewed, frayed, cracked, stretched, loose, weakened, defective, or otherwise unsafe;
  • Following all product instructions, warnings, sizing guidance, and care instructions;
  • Ensuring your dog is appropriately restrained and supervised;
  • Complying with leash laws, animal control laws, public safety laws, and other applicable rules; and
  • Managing your dog's behavior and interactions with people, animals, property, and surroundings.

Unless expressly stated by AMU in writing, AMU products are not chew-proof, escape-proof, pull-proof, indestructible, or guaranteed to prevent injury, escape, loss, or damage. To the fullest extent permitted by law, AMU is not responsible for injury, loss, escape, property damage, animal behavior, or other harm resulting from misuse, improper fit, lack of supervision, modification, ordinary wear and tear, failure to inspect the product, failure to follow product guidance, or your dog's behavior.

4. Orders, Pricing, and Payment

When you place an order, you agree to provide accurate, complete, and current information. You authorize AMU and its third-party payment processors to charge your selected payment method for all amounts due, including product prices, taxes, shipping, handling, and any other applicable charges. All prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, discounts, product availability, and shipping options may change at any time without notice.

We reserve the right to reject, cancel, limit, or refuse any order for any reason, including suspected fraud, unauthorized resale, pricing errors, product availability issues, incorrect product information, incorrect addresses, payment issues, or violation of these Terms. If we cancel an order after payment has been processed, we will issue a refund for the amount charged for the canceled item, subject to our payment processor's timing and policies.

AMU currently accepts payments through Shopify Payments and Shop Pay.

5. Shipping and Delivery

AMU currently ships within the United States, including all 50 states. Shipping and delivery dates are estimates only and are not guaranteed unless expressly stated in writing. AMU is not responsible for delays caused by carriers, weather, incorrect addresses, payment issues, supply chain issues, or events outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. If you provide an incorrect or incomplete address, your order may be delayed, returned, or undeliverable. AMU's policy is to refund customers for packages that are confirmed lost, stolen, or undelivered, subject to reasonable verification and our policies.

6. Returns, Exchanges, and Refunds

AMU offers a 30-day return window, subject to the terms of our Return Policy. Unless otherwise stated in the Return Policy or required by law, returned products must be returned in accordance with AMU's return instructions. AMU does not currently designate any launch products as final sale.

AMU offers a 30-day warranty for manufacturer defects. This warranty applies only to manufacturer defects and does not cover misuse, improper fit, accidents, ordinary wear and tear, chewing, scratching, improper cleaning, unauthorized modification, lost items, stolen items, or damage caused by pets, people, or external conditions.

7. Promotions and Programs

AMU may offer promotions, discounts, giveaways, referral programs, ambassador programs, affiliate programs, loyalty benefits, or similar programs from time to time. These may be subject to additional terms, restrictions, eligibility requirements, expiration dates, and availability limits. Unless expressly stated otherwise, promotions cannot be combined, transferred, applied retroactively, redeemed for cash, or used after expiration. AMU may modify, suspend, or cancel any promotion at any time to the extent permitted by law.

If you participate in an affiliate, ambassador, influencer, referral, or similar program, you must comply with all applicable laws and platform rules, including disclosure requirements for paid, gifted, affiliate, sponsored, or incentivized endorsements.

8. Accounts

You may be required or permitted to create an account to access certain features. You agree to provide accurate, current, and complete information and to update that information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify AMU promptly if you suspect unauthorized access to your account. We may suspend, restrict, or terminate your account if we believe you have violated these Terms, engaged in fraudulent or harmful conduct, or created risk for AMU, customers, pets, or third parties.

9. Acceptable Use

You agree not to misuse the Services or engage in conduct that could harm AMU, other users, our partners, vendors, pets, or third parties. You may not:

  • Use the Services for unlawful, fraudulent, deceptive, harmful, or abusive purposes;
  • Violate any applicable law, regulation, or third-party right;
  • Interfere with or disrupt the Services, servers, networks, or security systems;
  • Attempt to gain unauthorized access to any account, system, data, or portion of the Services;
  • Use bots, scrapers, crawlers, automated tools, or similar technologies without our written permission;
  • Copy, modify, reverse engineer, or create derivative works from the Services;
  • Upload or transmit viruses, malware, or harmful code;
  • Impersonate another person or misrepresent your affiliation with any person or entity;
  • Submit false reviews, manipulate ratings, or engage in deceptive promotional activity;
  • Purchase products for unauthorized resale, dropshipping, marketplace arbitrage, or commercial distribution; or
  • Use AMU's name, branding, content, products, photos, or designs in a way that suggests sponsorship, endorsement, affiliation, or authorization without our written permission.

10. No Unauthorized Resale

AMU products are intended for personal use and authorized sales channels only. You may not purchase AMU products for resale, dropshipping, marketplace listings, commercial distribution, or other unauthorized commercial purposes without AMU's prior written consent. We reserve the right to refuse, cancel, limit, or investigate orders that we believe may involve unauthorized resale, fraud, abuse, or violation of these Terms.

11. User Content

The Services may allow you to submit, post, upload, tag, display, transmit, or otherwise share content, including reviews, photos, videos, comments, testimonials, social media posts, pet images, pet names, and other materials ("User Content").

You retain ownership of your User Content. However, by submitting User Content to AMU, tagging AMU, using AMU hashtags, participating in AMU campaigns, or otherwise making content available to AMU, you grant AMU a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, perform, and create derivative works from your User Content in connection with AMU's business, including marketing, advertising, social media, website content, email, packaging, retail, public relations, and promotional materials.

You represent and warrant that:

  • You own or have all rights necessary to submit the User Content;
  • The User Content is accurate and not misleading;
  • The User Content does not infringe, misappropriate, or violate any third-party rights;
  • You have obtained any required permissions from people appearing in the User Content;
  • The User Content does not violate these Terms or applicable law; and
  • Your User Content does not include content that is unlawful, defamatory, obscene, harassing, threatening, hateful, abusive, deceptive, or otherwise inappropriate.

We may remove, edit, decline to post, or stop using User Content at any time for any reason.

12. Reviews and Testimonials

If you submit a review, rating, testimonial, or similar content, you agree that your submission reflects your honest opinion and actual experience. You may not submit reviews that are false, misleading, compensated without disclosure, posted on behalf of someone else, or intended to manipulate ratings. We may display reviews with your name, username, initials, pet name, location, or other information you provide, subject to our Privacy Policy.

13. Intellectual Property

The Services and all content, features, designs, text, graphics, logos, icons, images, videos, photographs, product names, product designs, software, packaging, trade dress, and other materials made available by AMU are owned by AMU or its licensors and are protected by copyright, trademark, trade dress, patent, and other intellectual property laws. AMU, Amu Pets LLC, the AMU name, AMU logos, product names, slogans, designs, packaging, and related branding are trademarks, trade names, or trade dress of AMU.

You may not use, copy, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, sell, exploit, or otherwise use any AMU intellectual property without our prior written permission, except as expressly permitted by these Terms.

14. Third-Party Services and Links

The Services may contain links to third-party websites, apps, platforms, payment processors, shipping providers, social media platforms, or other services. AMU does not control and is not responsible for third-party services, content, policies, practices, availability, or security. Your use of third-party services is governed by the applicable third party's terms and policies. AMU is not responsible for any loss or damage arising from your use of third-party services.

15. Privacy

Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that we process personal information as described in the Privacy Policy.

16. SMS, Email, and Marketing Communications

You may choose to receive marketing emails, SMS messages, or other communications from AMU. By signing up, you agree to receive communications from us, subject to applicable law and any additional terms presented at signup. You may unsubscribe from marketing emails using the unsubscribe link in the email. You may opt out of SMS messages by replying "STOP" or following the instructions provided in the message. Message and data rates may apply to SMS messages. Message frequency may vary. Transactional or service-related communications may still be sent where permitted by law.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, except as expressly stated in AMU's written warranty or return policy.

Without limiting the foregoing, AMU disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, quiet enjoyment, and any warranties arising from course of dealing or usage of trade. AMU does not warrant that the Services will be uninterrupted, secure, error-free, accurate, complete, or free of viruses or harmful components. AMU does not warrant that any product will meet your expectations, be suitable for every dog, fit every dog, prevent escape, withstand all chewing or pulling, or perform under all conditions.

Some jurisdictions do not allow limitations on implied warranties, so some of the above limitations may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, AMU and its owners, officers, directors, employees, contractors, agents, affiliates, suppliers, service providers, licensors, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, loss of data, loss of goodwill, personal injury, property damage, pet injury, pet escape, replacement costs, or loss arising out of or relating to your access to or use of the Services or products, even if AMU has been advised of the possibility of such damages.

To the fullest extent permitted by law, AMU's total liability for any claim arising out of or relating to the Services, products, or these Terms will not exceed the greater of: (a) the amount you paid to AMU for the product giving rise to the claim; or (b) $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

19. Indemnification

You agree to indemnify, defend, and hold harmless AMU and its owners, officers, directors, employees, contractors, agents, affiliates, suppliers, service providers, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • Your use or misuse of the Services or products;
  • Your violation of these Terms;
  • Your violation of applicable law or third-party rights;
  • Your User Content;
  • Your unauthorized resale or commercial use of AMU products;
  • Your dog's behavior, conduct, injury, escape, or interaction with any person, animal, property, or environment; or
  • Your negligence, willful misconduct, fraud, or misrepresentation.

AMU reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

21. Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms, the Services, or products will be governed by the laws of the State of Texas, without regard to conflict of law principles. Subject to the arbitration agreement above, you and AMU consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California for any dispute that is not subject to arbitration.

22. Changes to the Services or Terms

We may update, modify, suspend, discontinue, or remove any part of the Services at any time without notice. We may also update these Terms from time to time. The updated Terms will be posted on the Services with a revised "Last Updated" date. Unless otherwise stated, updates are effective when posted. Your continued use of the Services after updated Terms are posted means you accept the updated Terms.

23. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for AMU, engaged in fraudulent or abusive conduct, or otherwise used the Services in a way that may harm AMU, users, pets, or third parties. Sections that by their nature should survive termination will survive, including provisions relating to intellectual property, User Content licenses, disclaimers, limitations of liability, indemnification, arbitration, governing law, and dispute resolution.

25. Miscellaneous

These Terms, together with any policies referenced in them, constitute the entire agreement between you and AMU regarding the Services and supersede any prior or contemporaneous agreements relating to the same subject matter. If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect. AMU's failure to enforce any provision of these Terms will not be considered a waiver of that provision or any other right.

You may not assign or transfer these Terms without our prior written consent. AMU may assign or transfer these Terms without restriction, including in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. No agency, partnership, joint venture, employment, or franchise relationship is created by these Terms.
